Message Here was my interrogation list for the two officers. Okizaki was the one who pulled me over after being radioed by Anders:

Opening:
The main purposes of discovery are to find evidence, avoid surprises, narrow the issues, perpetuate testimony, obtain testimony from outside the state, and permit the recovery of certain costs and fees. By doing these things, discovery will help you prepare for trial or dispositive motions, force your opponent to come to grips with any weaknesses in his case, and facilitate settlement. If, in each of your cases, you keep the goals of your discovery firmly in mind, you will be better able to decide which discovery you need and which would be unnecessary or harmful.

Based on California PC 1054.1, whether the DA takes an active role or not is of no consequence. the code states to send an informal discovery request to the DA and not the witness, which I did, and was re-directed to send the request TO the officer. The DA has 20 days to respond to the judge's order for discovery, yet there was no response from Officer Anders.

Questions:

Okizaki –
Thank you, Officer Okizaki and to Captain Dial, for responding to my request for discovery and for the submittal of your Trial by Declaration form in a timely manner.

-Officer Okizaki, was the alleged offense committed in your presence? (no)
-So you weren’t using RADAR, LIDAR, or any other form of speed determination when the vehicle passed you? (no)

-Did you get a visual estimation of the speed? (no)

-When you approached the vehicle in question, did you get a RADAR read on the vehicle? (no)

-Did you pace the vehicle? (no)

-So as far as you know – while in your presence – the vehicle was not speeding? (no)

Thank you for your time, Sir.

Anders –
-Officer Anders: I’m in a bit of a pickle here since you decided to ignore my requests for discovery so I could be prepared for this trial.

-Could you please explain to the court the methodology used in determining the speed of the vehicle in question? (air pace of plane using markers, not pace of vehicle)

-Can you please provide the distance and the time between markers? (he'll have this, but he will have the times for my car mixed up with Wade's car that was behind me).

-Can you please provide the court with the timer certification? (he'll have this)

-How many officers were timing vehicles at the time? (1)
-How many timing devices were being used? (1)

-How many vehicles were you pacing at the time? (2)

-Which vehicle was in the front and which was in the rear? (he didn't know)

-How far apart were the vehicles?

-Can you time two vehicles with one timing device? (no)

-What were the times between the markers for each of the two vehicles at the time?

(Time aircraft between two marks, typically ½ mile, in a Cessna 206 with a stall speed of 40mph)
